Treasury Targets Belarusian State-Owned Enterprises, Government Officials, and Lukashenka’s Aircraft

March 24, 2023

WASHINGTON — Today, the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) is designating three entities and nine individuals, and identifying one presidential aircraft as blocked property, pursuant to Executive Order (E.O.) 14038. These designations build on sanctions imposed on individuals and entities in Belarus in response to the ongoing brutal crackdown against the pro-democracy movement and civil society surrounding the fraudulent August 2020 presidential election. These actions also underscore the United States’ willingness to hold the regime in Minsk to account for its complicity in the Russian Federation’s ongoing unjustified war of choice against Ukraine.

 “The authoritarian Lukashenka regime relies on state-owned enterprises and key officials to generate substantial revenue that enables oppressive acts against the Belarusian people,” said Under Secretary of the Treasury for Terrorism and Financial Intelligence Brian Nelson. “We remain committed to imposing costs on the Lukashenka regime for its suppression of democracy and support for Putin’s war of choice.”

Concurrently and in the spirit of Belarusian Freedom Day, the Department of State is announcing actions to impose visa restrictions on an additional 14 individuals, including regime officials involved in policies to threaten and intimidate the Belarusian people, for their involvement in undermining democracy under Presidential Proclamation 8015.

Today’s actions further align the United States with its international partners and allies in ensuring the Lukashenka regime pays a price for its abysmal treatment of its own citizens and assistance to the Putin regime.  

REVENUE GENERATING BELARUSIAN STATE-OWNED ENTERPRISES

Open Joint Stock Company Belarusian Automobile Plant (BelAZ) is one of the largest manufacturers of large trucks and large dump trucks in the world. Employees of BelAZ who took part in strikes and peaceful protests in the aftermath of the fraudulent August 2020 presidential election in Belarus were threatened with layoffs and intimidated by company management. Lukashenka has stated that the government will always support BelAZ and described it as a “Belarusian brand” and “part of the national legacy.” BelAZ’s Director is Sergei Olegovich Nikiforovich (Nikiforovich). BelAZ was previously designated by the European Union (EU) and Canada.

OFAC is designating BelAZ pursuant to E.O. 14038 for being owned or controlled by, or for having acted or purported to act for or on behalf of, directly or indirectly, the Government of Belarus (GoB).

OFAC is designating Nikiforovich pursuant to E.O. 14038 for being or having been a leader or official of the GoB.

Open Joint Stock Company Minsk Automobile Plant (MAZ) is one of the biggest automotive manufacturers in Belarus and a significant source of revenue for the Lukashenka regime. Employees of MAZ who took part in strikes and peaceful protests in the aftermath of the fraudulent August 2020 presidential election in Belarus were intimidated and later laid off by the company’s management. MAZ’s Director is Valery Valerievich Ivankovich (Ivankovich). MAZ and Ivankovich were previously designated by the EU and Canada.

OFAC is designating MAZ pursuant to E.O. 14038 for being owned or controlled by, or for having acted or purported to act for or on behalf of, directly or indirectly, the GoB.

OFAC is designating Ivankovich pursuant to E.O. 14038 for being or having been a leader or official of the GoB.

ELECTION FRAUD

Central Election Commission of the Republic of Belarus (CEC) was originally designated on December 23, 2020, pursuant to Belarus-related E.O. 13405 following the fraudulent August 2020 presidential election. The CEC played a role in barring opposition candidates, denying access to poll observers, and certifying inaccurate vote tallies. OFAC previously designated senior members of the CEC in the wake of the fraudulent August 2020 presidential election and is adding members of the commission that have joined since that time. These new members include Ihar Vasilyevich Karpenka (Karpenka), Alena Anatolieuna Baldouskaya (Baldouskaya), Dzyanis Uladzimiravich Duk (Duk), Alena Kanstantsinauna Kuntsevich (Kuntsevich), Alyaksandr Henadzievich Tkachou(Tkachou), Katsyaryna Alyaksandrauna Fedasenka (Fedasenka), and Alyaksandr Uladzimiravich Yuzhyk (Yuzhyk). Karpenka was previously designated by the EU and Canada. 

OFAC is designating CEC pursuant to E.O. 14038 for being a political subdivision, agency, or instrumentality of the GoB.

OFAC is designating Karpenka, Baldouskaya, Duk, Kuntsevich, Tkachou, Fedasenka, and Yuzhyk pursuant to E.O. 14038 for being or having been leaders or officials of the GoB.

LUKASHENKA’S LUXURY AIRLINER

EW-001PA is a Boeing 737 belonging to the GoB and used as the presidential aircraft for the U.S.-sanctioned leader of Belarus, Alyaksandr Hryhoryavich Lukashenka. Lukashenka has exclusive access to EW-001PA and other luxury aircraft and uses them for personal trips. Moreover, Lukashenka has used EW-001PA with his family and other members of his entourage for international travel.

OFAC is identifying EW-001PA as property in which Lukashenka, a person whose property and interests in property are blocked pursuant to E.O. 14038, has an interest.

SANCTIONS IMPLICATIONS

As a result of today’s action, all property and interests in property of the designated persons described above that are in the United States or in the possession or control of U.S. persons are blocked and must be reported to OFAC. In addition, any entities that are owned, directly or indirectly, individually or in the aggregate, 50 percent or more by one or more blocked persons are also blocked. Unless authorized by a general or specific license issued by OFAC, or exempt, OFAC’s regulations generally prohibit all transactions by U.S. persons or within (or transiting) the United States that involve any property or interests in property of designated or otherwise blocked persons.

In addition, financial institutions and other persons that engage in certain transactions or activities with the sanctioned entities and individuals may expose themselves to sanctions or be subject to an enforcement action. The prohibitions include the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any designated person, or the receipt of any contribution or provision of funds, goods, or services from any such person.

The power and integrity of OFAC sanctions derive not only from OFAC’s ability to designate and add persons to the SDN List but also from its willingness to remove persons from the SDN List consistent with the law. The ultimate goal of sanctions is not to punish but to bring about a positive change in behavior. Taking Additional Actions to Hold the Lukashenka Regime to Account

The United States continues to promote accountability for the Lukashenka regime’s violence surrounding the fraudulent August 2020 presidential election in Belarus, its ongoing brutal crackdown against the pro-democracy movement and other elements of Belarusian society, its flagrant human rights abuses, and its facilitation of the Russian Federation’s illegal war against Ukraine.

Specifically, the U.S. Department of the Treasury is designating today two state-owned enterprises; Open Joint Stock Company Belarusian Automobile Plant and Open Joint Stock Company Minsk Automobile Plant.

Further, Treasury is re-designating the Central Election Commission of the Republic of Belarus and designating seven members of the Commission.

The Department of State is announcing actions to impose visa restrictions on an additional 14 individuals under Presidential Proclamation 8015 for their involvement in undermining democracy in Belarus. Specifically, these individuals include regime officials involved in policies to threaten and intimidate brave Belarusians exercising their human rights and fundamental freedoms at great personal cost.

Today’s actions further align the United States with actions taken by our partners and Allies. The United States will continue to impose costs on the regime and those who support it for their repression of the people of Belarus, and the regime’s ongoing support for Russia’s unprovoked and illegal war against Ukraine.

Treasury Sanctions Jet Fuel Suppliers and Military Cronies in Burma Prior to Armed Forces Day

March 24, 2023

WASHINGTON – Today, the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) designated two individuals and six entities that are connected to Burma’s military and that have enabled the military regime’s continuing atrocities, including through the importation, storage, and distribution of jet fuel to Burma’s military. These actions come as the military regime prepares to mark the 78th Armed Forces Day. The two individuals and six entities are being designated pursuant to Executive Order (E.O) 14014. 

Following the February 1, 2021, military coup that overthrew Burma’s democratically elected civilian government, the military regime has continued to commit atrocities and violence against the people of Burma, with an increasing reliance on air strikes with unguided munitions and rockets in civilian populated areas. These attacks include air strikes in late 2022 on the village of Let Yet Kone in central Burma that impacted a school with children and teachers present, as well as an air strike in the northern state of Kachin that killed as many as 80 people who were attending a musical concert.

Today, OFAC also published a Burma Jet Fuel Sanctions Alert, to inform individuals, businesses, and other persons of the sanctions risks associated with providing jet fuel to Burma’s military regime.

“Burma’s military regime continues to inflict pain and suffering on its own people,” said Under Secretary of the Treasury for Terrorism and Financial Intelligence Brian E. Nelson. “The United States remains steadfast in its commitment to the people of Burma, and will continue to deny the military the materiel it uses to commit these atrocities.”

BURMESE MILITARY AVIATION FUEL SUPPLIERS

Today’s action targets three entities for operating in the defense sector of the Burmese economy, specifically based on their involvement in the importation, storage, and distribution of jet fuel to Burma’s military. In November 2022, many civil society organizations reported that without jet fuel, Burma’s military would have no means to power the aircraft used in air strikes. ASIA SUN GROUP is a Burma-based company and a key operator in the jet fuel supply chain supporting brutal military regime and the atrocities that have been committed in Burma. It is also sanctioned by Canada and the European Union.

ASIA SUN TRADING CO. LTD. is a Burma-based company that has purchased jet fuel on behalf of Burma’s air force and imported it through the Thilawa Port. It was designated by the United Kingdom earlier this year.

CARGO LINK PETROLEUM LOGISITICS CO. LTD. is a Burma-based company that is the transport contractor that has used tanker trucks to distribute jet fuel to military bases across Burma. It was designated by the United Kingdom earlier this year.

Asia Sun Group, Asia Sun Trading Co. Ltd., and Cargo Link Petroleum Logistics Co. Ltd. are being designated pursuant to E.O. 14014 for operating in the defense sector of the Burmese economy.

BURMESE DEFENSE RELATED CRONIES

Today’s action also targets individuals and entities that are associated with or have provided equipment to Burma’s military.

TUN MIN LATT is a Burmese national and close associate of U.S.-designated military regime leader Min Aung Hlaing and is the son of a former military official. Tun has utilized his companies, including the Burma-based STAR SAPPHIRE GROUP OF COMPANIES and Burma-based STAR SAPPHIRE TRADING COMPANY LIMITED, to import military arms and equipment, including drones and aircraft parts, while acting as Burma’s agent with the U.S.-sanctioned People’s Republic of China arms manufacturer NORINCO. Additionally, Tun was arrested in Thailand in September 2022 on charges of narcotics trafficking and money laundering. When he was arrested, Thai police found numerous documents that belonged to Min’s U.S.-designated children, including his son, Aung Pyae Sone, and daughter, Khin Thiri Thet Mon.

Tun Min Latt is being designated pursuant to E.O. 14014 for operating in the defense sector of the Burmese economy.

WIN MIN SOE is the wife of Tun Min Latt and is a co-owner with him of both Star Sapphire Trading Company Limited and the Singapore-based STAR SAPPHIRE GROUP PTE. LTD.

Win Min Soe is being designated pursuant to E.O. 14014 for being a spouse or adult child of Tun Min Latt, a person whose property and interests in property are blocked pursuant to E.O. 14014.

Star Sapphire Group of Companies, Star Sapphire Trading Company Limited, and Star Sapphire Group Pte. Ltd. are being designated pursuant to E.O. 14014 for being owned or controlled by, or for having acted or purported to act for or on behalf of, directly or indirectly, Tun Min Latt, a person whose property and interests in property are blocked pursuant to E.O. 14014. Star Sapphire Group Pte. Ltd. is also being designated pursuant to E.O. 14014 for being owned or controlled by, or for having acted or purported to act for or on behalf of, directly or indirectly Win Min Soe, a person whose property and interests in property are blocked pursuant to E.O. 14014.

SANCTIONS IMPLICATIONS

As a result of today’s action, pursuant to E.O. 14014, all property and interests in property of the persons named above that are in the United States, or in the possession or control of U.S. persons, are blocked and must be reported to OFAC. In addition, any entities that are owned, directly or indirectly, 50 percent or more by one or more blocked persons are also blocked.

Unless authorized by a general or specific license issued by OFAC, or otherwise exempt, OFAC’s regulations generally prohibit all transactions by U.S. persons or within (or transiting) the United States that involve any property or interests in property of designated or otherwise blocked persons. The prohibitions include the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any blocked person or the receipt of any contribution or provision of funds, goods, or services from any such person.

U.S. sanctions need not be permanent. Sanctions are intended to bring about a positive change of behavior. Consistent with the findings of Treasury’s Sanctions Review, the removal of sanctions is available for persons designated under E.O. 14014, who take concrete and meaningful actions to restore the path to democracy and disassociate themselves from the military-led government in Burma. The United States continues to promote accountability for the Burmese military regime’s assault on the democratic aspirations of the people of Burma.  Today we are designating two individuals and six entities.  The regime continues to inflict pain and suffering on the people of Burma.

The U.S. Department of the Treasury is imposing sanctions on Tun Min Latt and his spouse Win Min Soe, as well as three entities owned or controlled by Tun Min Latt.

Additionally, Treasury is issuing a Sanctions Alert on Burma jet fuel to inform individuals, businesses, and other persons of the sanctions risks associated with the provision of jet fuel to Burma’s military regime.

The actions we are taking today further align with those taken by Canada, the European Union, and the United Kingdom. The United States is committed to supporting the people of Burma and will continue to take actions to deny the regime the resources it uses to commit these atrocities.
